1. AI Disclosure & Limitations

Evolv Systems develops and deploys AI-powered SMS communication systems for businesses. By using our services or interacting with our AI systems, you acknowledge that:

Our AI systems generate responses using artificial intelligence and large language models. While designed to be accurate and helpful, AI-generated responses may occasionally contain errors or inaccuracies.

AI systems operated by Evolv are not substitutes for professional advice (legal, financial, medical, or otherwise). Information provided by our AI systems is for general informational and conversational purposes only.

The performance, accuracy, and behavior of AI systems may vary. We continuously monitor and improve our systems but cannot guarantee specific outcomes.

Evolv Systems AI androids may or may not identify themselves as AI during conversations, depending on the configuration chosen by the business deploying the system. Echo, our demo bot, is clearly identified as an AI system on this website.

2. Limitation of Liability

To the fullest extent permitted by applicable law, Evolv Systems LLC, its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:

Your use of or inability to use our website or services

Any errors, inaccuracies, or omissions in AI-generated content

Unauthorized access to or alteration of your data

Any third-party conduct or content

SMS message delivery failures caused by carrier networks, device settings, or other factors outside our control

Our total liability for any claim arising from or related to our services shall not exceed the amount you have paid to Evolv Systems in the three (3) months preceding the claim, or one hundred dollars ($100), whichever is greater.

This website and all services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied.

Governing law

These terms shall be governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Eau Claire County, Wisconsin.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these terms shall otherwise remain in full force and effect.

3. Changes to This Policy & Contact Information

We may update this Privacy Policy and Terms of Use from time to time. Changes will be posted on this page with an updated "Last updated" date. Your continued use of our website or services after changes are posted constitutes acceptance of the revised terms.

For material changes that affect how we handle your personal information or SMS consent, we will make reasonable efforts to notify you through the contact information on file.

SMS COMMUNICATION POLICY

You must be 18 years of age or older to use this SMS service.

4. SMS Communication & Consent

Consent disclosure: By submitting your phone number through any form on evolvsystems.tech — including the Echo demo form, booking calendar, or contact form — you provide your prior express written consent to receive SMS text messages from Evolv Systems LLC at the phone number provided. These messages may be sent using automated technology.

What you are consenting to

By providing your phone number and submitting a form on our website, you expressly consent to receive:

AI-generated SMS messages from the Evolv Echo demo bot or other Evolv AI systems

Follow-up text messages related to your inquiry, service interests, or appointment

Appointment confirmations, reminders, and scheduling-related communications

Informational messages about Evolv Systems services you have expressed interest in

Message frequency

Message frequency varies based on your interaction. Submitting the Echo demo form will initiate a conversational SMS exchange. You may receive multiple messages as part of a single conversation. Appointment-related messages are typically limited to confirmation and reminder messages. You will not be enrolled in any ongoing promotional messaging campaign without additional explicit consent.

Message and data rates

Message and data rates may apply. Evolv Systems is not responsible for charges from your wireless carrier related to SMS messaging. Contact your carrier for details about your messaging plan.

Consent is not a condition of purchase

Providing consent to receive SMS messages is not a condition of purchasing any service from Evolv Systems. You may inquire about our services through other means, including email or phone call, without consenting to SMS communication.

A2P compliance

All SMS messages sent by Evolv Systems are transmitted through A2P (Application-to-Person) verified channels registered with mobile carriers. Our messaging infrastructure complies with carrier requirements for business SMS communication, including 10DLC registration where applicable.

Sending hours

Evolv Systems will not send automated SMS messages outside the hours of 8:00 AM to 9:00 PM in the recipient's local time zone, in accordance with TCPA requirements. Messages initiated by the recipient (such as replies within an active conversation) may be responded to outside these hours.

5. SMS Opt-Out & Revocation of Consent

To stop receiving messages at any time: Reply STOP to any SMS message from Evolv Systems. You may also opt out by emailing us or calling us at the contact information below.

How to opt out

You may revoke your consent to receive SMS messages at any time through any of the following methods:

Reply STOP: Text the word STOP (or UNSUBSCRIBE, CANCEL, END, or QUIT) in response to any message from Evolv Systems

Email: Send a request to the email address listed in Section 12 with your phone number and a request to be removed

Phone: Call or leave a voicemail at the number listed in Section 12

Written request: Any other reasonable method of communicating your desire to stop receiving messages

Processing timeline

Opt-out requests submitted via STOP keyword are processed immediately and automatically. Your number will be added to our internal suppression list and removed from all active campaigns. Opt-out requests submitted through other channels will be processed within ten (10) business days of receipt.

Confirmation message

After receiving an opt-out request, we may send a single confirmation message to acknowledge that your request has been processed. This confirmation message will contain no promotional content.

Re-opting in

If you previously opted out and wish to receive messages again, you must provide new express written consent by submitting a form on our website or by texting START to the number from which you previously received messages.

6. Echo Demo Bot Terms

Echo is a live AI demonstration system operated by Evolv Systems. By submitting the Echo contact form or texting the Echo phone number directly, you acknowledge and agree to the following:

Echo is an AI-powered system that generates responses using artificial intelligence technology. It is not a human representative.

Conversations with Echo are for demonstration purposes and to assess your interest in Evolv Systems services.

Information you provide during an Echo conversation (including your name, phone number, business details, and message content) will be stored in our CRM system.

Echo conversations may be reviewed by Evolv Systems team members for quality assurance, system improvement, and to facilitate follow-up by a human team member when appropriate.

Echo will not ask for or process sensitive personal information such as credit card numbers, Social Security numbers, or account passwords. Do not share this information in any SMS conversation.

If at any point during an Echo conversation you wish to speak with a human representative, the system will facilitate an immediate handoff. If you wish to stop the conversation entirely, reply STOP.
